Last night around 4-5am, My girlfriend, who is 18, her friend, who is 20, her boyfriend, who is 19, and myself who is 21, were playing beer pong. We were using alcohol that I purchased earlier that week. Well my neighbors are really anal and call the cops if they hear my vacuum going off around 10am. So anyways they said something about us running up and down the stairs is why they called the police this time, which is ridiculous. Anyways, while I was in the restroom the officers walked in and saw the pong table and then went to go get the breathalyzer. The two friends of ours came up over .02 which is illegal in Michigan if you are under 21 so I was hit with a Furnishing alcohol to minors charge. My question is what is going to come with it. Am I going to get hit with like a 1,000$ fine and jail time? We all had our pajamas on so there was no intent to drive, and we were in the privacy of our own home. I understand they shouldn’t be drinking but it’s not like they can’t go anywhere else and do it, I rather my good friends, if they do have to drink, do it with me because I am responsible enough to not let them drive home. Anyways, some answers would be great, especially if you had this charge before. Thanks.

    Good news,

They are not minors and you were hit with the wrong charge. Although they were drinking under the legal age, none of those people described are minors, which in your state is under 17.

Secondly, as long as the state cannot prove that you charged them for the alchohol you have no problem whatsoever. I have two sons aged 11 and 8 and I give them a glass of wine during thanksgiving, christmas and easter. One drink will make you blow a .02 so are the police going to come and arrest me.

If you can get a good attorney, you may have a false arrest case on your hands and I bet the DA will look at the file and beg you to accept a disturbance of the peace, prob….25 to 50 bucks…

If they just gave you a ticket and did not make you go through the arraignment process then it is a misdemeanor so def. no jail time.

When dealing with cops in the future please remember the following….

NO ONE SHOULD HAVE LET THE POLICE IN YOUR HOUSE WITHOUT A WARRANT…. NEVER EVER DO THAT AGAIN!

and I HOPE YOU KEEP YOUR MOUTH SHUT IN FRONT OF THE POLICE, LET THEM SOLVE THEIR CASE ON THIER OWN! Jack B
